Terms and conditions
These terms govern the use of ChairSide Delivery by customers, licensed beauty professionals, beauty supply stores and delivery drivers. Please read them before you place an order, list a product or accept a delivery.

We publish these terms in full so that you can read them before you use ChairSide. We update this page from time to time, and the effective date above always shows the current version.
1. Who we are and acceptance of these terms
1.1 ChairSide Delivery (the "Platform") is operated by Chairside, LLC, a North Carolina limited liability company with its principal place of business in Zebulon, North Carolina, United States. In these terms, "ChairSide", "we", "us" and "our" mean Chairside, LLC.
1.2 ChairSide is a same day delivery marketplace for professional beauty and salon supplies. We connect customers with participating local beauty supply stores and with independent delivery drivers who carry each order from the store to the delivery address. We operate in Raleigh and the wider North Carolina Triangle area.
1.3 By creating an account, placing an order, listing products as a store, or accepting a delivery as a driver, you agree to these terms. If you do not agree, do not use the Platform. If you use the Platform for a salon, shop or company, you confirm that you are authorised to accept these terms for that business, and "you" means both you and that business.
1.4 ChairSide is not a beauty supply retailer and is not a delivery employer. Stores sell the products. Drivers perform the deliveries as independent contractors. We provide the technology, the marketplace and the support service that bring the two together.
2. Definitions
"Customer" means any person who places an Order through the Platform. "Pro" means a Customer whose cosmetology, barbering, nail or esthetics licence has been verified by us, and who therefore has access to professional pricing. "Merchant" means a beauty supply store that lists and sells products through the Platform. "Driver" means an independent contractor who accepts and completes deliveries through the Platform.
"Order" means a request placed through the Platform for products from a single Merchant, together with the delivery of those products. "ChairSide Credit" means non cash balance issued by us that can be applied to a future Order. "Content" means text, images, product listings, reviews, ratings and any other material made available on the Platform.
3. Eligibility and your account
3.1 You must be at least 18 years old and able to form a binding contract to use the Platform. The Platform is offered only in the parts of North Carolina where we operate.
3.2 You must give accurate, current and complete information when you register, and keep it up to date. You may hold one account only, unless we agree otherwise in writing for a business account.
3.3 You are responsible for your login credentials and for all activity on your account. Tell us without delay at admin@chairsidedelivery.com if you believe your account has been used without your permission.
3.4 You may close your account at any time from the app or by writing to us. We may suspend or close an account, refuse an Order, or remove access to professional pricing if we reasonably believe that you have broken these terms, given false information, created a safety risk, or used the Platform unlawfully. Where it is practical and lawful to do so, we will tell you why.
3.5 Closing an account does not cancel amounts already owed, orders already in progress, or any section of these terms that is stated to survive termination.
4. Licensed professional verification and professional pricing
4.1 Licensed cosmetology professionals, including stylists, barbers, nail technicians and estheticians, may apply for a Pro account. Pro accounts can see and buy at the wholesale or professional prices that participating Merchants choose to offer.
4.2 To verify a Pro account we ask for your licence number and a photograph of a government issued identity document, and we check them against state licensing records, either directly or through a licence verification provider. We may ask for further evidence, and we may repeat the check at any time while your account is open.
4.3 The licence must be current, valid and issued in your name. You must tell us if it lapses, is suspended or is revoked. Professional pricing is personal to the verified holder. You must not share your Pro account, order on behalf of an unlicensed person so that they receive professional pricing, or resell professional priced goods in a way that a Merchant has prohibited.
4.4 If a licence cannot be verified, has expired, or has been used in breach of clause 4.3, we may remove professional pricing, cancel affected Orders, and suspend or close the account.
4.5 Professional prices are set by each Merchant. We do not guarantee that every Merchant offers professional pricing, or that it is available on every product.
5. Orders, prices, substitutions and cancellation
5.1 Each checkout covers products from one Merchant. You may keep more than one cart at a time and check them out separately.
5.2 Placing an Order is an offer to buy the listed products at the listed price. The contract of sale for the products is between you and the Merchant. ChairSide arranges the marketplace, the payment and the delivery, and acts as the Merchant’s limited agent to collect payment for the products.
5.3 Merchants set their own prices. Prices on the Platform may be higher than the same product in the same store, because they can include the cost of preparing an Order for delivery. Prices, fees and availability can change before you place an Order.
5.4 You can schedule an Order in advance for a later window. A scheduled Order is confirmed with the Merchant nearer the time, and it is subject to stock and store hours in the same way as an immediate Order.
5.5 Substitutions. If a product is out of stock, the Merchant may propose a substitute before the Order is marked ready for pickup. You may accept the substitute, choose a different replacement where one is offered, or decline and receive a refund for that item. If you do not respond before the Order leaves the store, the item is removed and refunded. Drivers do not choose substitutes.
5.6 Cancellation. You may cancel free of charge until the Merchant begins to pick your Order. After picking starts, or after a Driver has collected the Order, we may keep the delivery fee and charge for perishable, mixed, opened or custom prepared items. We will tell you the cancellation cost before you confirm.
5.7 We or a Merchant may cancel an Order if a product is unavailable, if the price shown was clearly wrong, if the delivery address is outside our service area, or if we suspect fraud. You are refunded in full for any Order cancelled in this way.
6. Delivery, scheduling, PIN handover and failed deliveries
6.1 You must give a complete delivery address together with any access details the Driver needs, such as a suite number, salon name, gate code or parking note. Make sure that someone can receive the Order during the delivery window.
6.2 Delivery times shown in the app are estimates. Traffic, weather, store preparation time and Driver availability can change them. We will keep you updated in the app.
6.3 PIN handover. Orders at or above the value threshold published in the app require a four digit delivery PIN. The PIN appears on your Order screen. Give it to the Driver at the door, at the moment the Order is handed over. Do not send the PIN in advance, and do not ask a Driver to leave a PIN protected Order unattended. Entry of the correct PIN is proof that the Order was delivered to you.
6.4 For Orders without a PIN, you may ask for the Order to be left in a stated safe place. If you do, the risk of loss or damage passes to you once the Driver leaves it there and records proof of delivery.
6.5 Failed deliveries. If nobody is available, the Driver will attempt to contact you and will wait for a reasonable period. If the Order still cannot be handed over, it is returned to the Merchant. Where the failure is caused by a wrong address, an unreachable recipient, or a refusal to give a required PIN, we may keep the delivery fee and charge a return fee, and refund the balance.
6.6 Title and risk in the products pass to you on delivery, or at the point described in clause 6.4.
7. Payments, fees and taxes
7.1 Payments are processed by Stripe, our payment processor. Your card details are given directly to Stripe and are handled under Stripe’s terms and privacy policy. ChairSide does not store full card numbers.
7.2 The total shown at checkout includes the product prices, the delivery fee, any service fee, any tip you choose, and applicable state and local sales tax. We show every line before you confirm.
7.3 We may place an authorisation hold on your payment method when you place an Order, and take payment when the Order is confirmed by the Merchant or on delivery. Where the final total changes because of a substitution, a removed item or a weight based product, we charge or refund the difference.
7.4 Tips are optional and go to the Driver. You can set a tip at checkout and you can increase it from the Order screen after delivery.
7.5 You are responsible for any bank or card fee charged to you by your own provider. If a payment fails or is reversed, we may suspend your account until the balance is settled.
7.6 If you believe a charge is wrong, contact us before you raise a chargeback with your bank. Chargebacks raised for Orders that were delivered as described may lead to suspension of the account.
8. Refunds, ChairSide Credit and appeals
8.1 Tell us about a missing, incorrect or damaged item within 24 hours of delivery, through the Order screen in the app. Photographs of the item and its packaging are required for a damage or wrong item report.
8.2 Small refund requests are approved automatically and issued straight away as ChairSide Credit, so that you are not left waiting. Larger requests are reviewed by our support team, normally within three business days, and may be refunded to your original payment method or as ChairSide Credit.
8.3 ChairSide Credit has no cash value, cannot be exchanged for cash and cannot be transferred. It applies to future Orders on the Platform. Where credit is issued as a goodwill gesture with an expiry date, we state that date when we issue it.
8.4 We may decline a refund where a report is made outside the 24 hour window, where the evidence does not support the report, or where an account shows a repeated pattern of refund claims that we reasonably consider abusive.
8.5 Merchant appeals. Where a refund or a service failure is caused by a Merchant, we may charge that Merchant a penalty or recover the refunded amount from its payouts. The Merchant may appeal through the merchant dashboard within 48 hours of the notice, with supporting evidence. If no appeal is filed within that window, the charge becomes final.
9. Rules for Merchants
9.1 A Merchant must hold every licence, permit and registration needed to sell its products in North Carolina, and must keep them current.
9.2 Products must be genuine, lawfully obtained, within their shelf life, correctly labelled, and sold in line with any manufacturer restriction. Counterfeit, diverted, tampered, expired or recalled products must never be listed or supplied.
9.3 Listings must be accurate. Product names, sizes, images, ingredients, professional use restrictions and prices must match what is actually supplied. Stock levels must be kept current so that Customers are not sent Orders that cannot be filled.
9.4 Orders must be picked, packed and sealed within the preparation time agreed for the store, and handed to the assigned Driver shown in the app. Any substitution must be proposed through the Platform before the Order is marked ready for pickup.
9.5 Merchants are rated by Customers. We may publish performance measures, and we may suspend or remove a Merchant that repeatedly cancels Orders, supplies wrong or damaged goods, misses preparation times, or breaks these terms.
9.6 Commission, payout timing and any store specific arrangement are set out in the separate merchant agreement. Where that agreement and these terms conflict, the merchant agreement governs for the Merchant.
9.7 Merchants are also bound by clause 10.5 and clause 10.6, which restrict off platform solicitation of ChairSide Customers and the competing use of Platform data.
10. Rules for Drivers, independent contractor status and non-circumvention
10.1 Independent contractor status. Drivers are independent contractors. Nothing in these terms creates an employment, agency, partnership or joint venture relationship between a Driver and ChairSide. Drivers decide when to use the Platform and whether to accept any delivery offer, supply their own vehicle, phone and data, and are responsible for their own taxes, insurance, licences and business costs. ChairSide does not provide employee benefits, minimum earnings or set hours.
10.2 Onboarding. To deliver, you must hold a valid driving licence, valid vehicle registration and insurance that covers your use of the vehicle, and the right to work in the United States. You must pass our identity and background screening, which includes a photograph of a government issued identity document, and you must tell us at once if any of these lapse.
10.3 During a delivery. Keep location sharing switched on for the whole of an active delivery, so that the Customer and our support team can follow the Order. Follow storage and handling instructions, keep the Order sealed, collect the delivery PIN when one is required, and record proof of delivery in the app. Never open, use, keep, sell or give away any product from an Order.
10.4 Drivers are rated by Customers. We may suspend or remove a Driver for unsafe driving, dishonesty, theft, harassment, repeated late or failed deliveries, or any breach of these terms.
10.5 Non-solicitation and non-circumvention. While you use the Platform, and for twelve months after your last delivery or last Order fulfilled through it, a Driver or Merchant must not solicit, encourage or arrange for a ChairSide Customer who was introduced or served through the Platform to buy the same or similar products, or to obtain the same or similar delivery service, outside the Platform. This includes offering a private delivery arrangement, passing personal contact details for that purpose, placing promotional material in a ChairSide Order, taking payment for a delivery outside the Platform, and accepting an off platform order from a Customer who asks for one. This clause applies only to Customers introduced through ChairSide. It does not restrict a Merchant’s own walk in or pre-existing trade, and it does not stop a Driver working for any other company.
10.6 Competing use of Platform data. Customer names, addresses, telephone numbers, licence status, order history, pricing data and any other information obtained through the Platform are confidential and are provided only so that you can complete an Order. You must not copy, export, retain beyond the Order, publish, sell or share that information. You must not use it to build, operate or promote a competing delivery or supply service, to market to ChairSide Customers, or to train any dataset or model. Delete Order details once the Order is complete, unless the law requires you to keep them.
10.7 Because damage from a breach of clause 10.5 or clause 10.6 is hard to measure in money alone, we may seek injunctive relief in addition to any other remedy, and we may remove the account and withhold or recover fees connected with the breach. These two clauses survive the end of your use of the Platform.
11. Acceptable use
11.1 You must not: give false information or use another person’s identity, licence or payment method; misuse refunds, credits or promotions; harass, threaten or discriminate against a Driver, store employee, Customer or member of our team; order or supply anything unlawful; or use the Platform to breach any law or regulation.
11.2 You must not scrape, crawl, frame or bulk download the Platform, reverse engineer it, probe or test its security without our written permission, interfere with its operation, introduce malicious code, or access any account or data that is not yours.
11.3 You must not use the Platform to avoid our fees, including by taking a transaction that started on the Platform off the Platform.
11.4 Report a problem, a safety concern or a suspected breach to admin@chairsidedelivery.com.
12. Intellectual property and the ChairSide brand
12.1 The Platform, including its software, design, layout, text, graphics, photographs, icons and data compilations, is owned by Chairside, LLC or its licensors and is protected by copyright, trade mark and other laws. The names ChairSide and ChairSide Delivery, the ChairSide logo, and our product names are our marks.
12.2 We give you a limited, personal, revocable, non-exclusive and non-transferable licence to use the app and the website for their intended purpose. Any other use, including copying, adapting, reselling, or creating a derivative work, needs our written permission.
12.3 You must not use our name, logo or brand in advertising, on signage, in a domain name, or in any way that suggests a partnership or endorsement, without our written permission.
12.4 Content that a Merchant supplies, such as product images and descriptions, remains the property of that Merchant or its suppliers. By supplying it, the Merchant grants us a worldwide, royalty free licence to host, display, adapt for formatting and promote that Content in connection with the Platform.
12.5 If you send us feedback or an idea about the Platform, we may use it without restriction and without payment.
12.6 If you believe material on the Platform infringes your copyright, write to admin@chairsidedelivery.com with the work concerned, where it appears, your contact details, and a statement that you are the rights holder or authorised to act for one.
13. Disclaimers
13.1 The Platform is provided on an "as is" and "as available" basis. We do not warrant that it will be uninterrupted, timely, error free, or that every product listed will be in stock.
13.2 We do not manufacture, own or inspect the products sold through the Platform. Product quality, safety, labelling, authenticity and fitness for a purpose are the responsibility of the Merchant and the manufacturer. Any product warranty is given by them, not by us. Always read the manufacturer’s instructions and carry out a patch test where one is recommended.
13.3 To the fullest extent permitted by law, we disclaim all implied warranties, including implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. Some states do not allow the exclusion of certain implied warranties, so parts of this clause may not apply to you.
13.4 Delivery estimates, professional pricing eligibility and stock information depend on information supplied by Merchants and on live conditions, and are not guarantees.
14. Limitation of liability
14.1 To the fullest extent permitted by law, ChairSide is not liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost revenue, lost business, lost goodwill or lost data, whether or not we were told that such damage was possible.
14.2 To the fullest extent permitted by law, our total liability for all claims connected with the Platform or with any Order is limited to the greater of the amount you paid to ChairSide in the six months before the event giving rise to the claim, or one hundred United States dollars.
14.3 Nothing in these terms limits liability that cannot be limited by law, including liability for fraud, for wilful misconduct or gross negligence, or for death or personal injury caused by negligence.
14.4 These limits apply to every theory of liability, whether contract, tort, statute or otherwise, and survive the end of your account.
15. Indemnity
15.1 You agree to indemnify, defend and hold harmless Chairside, LLC, its members, officers, employees and agents against any claim, demand, loss, liability, damage, fine or expense, including reasonable legal fees, that arises out of your use of the Platform, your breach of these terms, your breach of any law, or your infringement of another person’s rights.
15.2 A Merchant additionally indemnifies us in respect of the products it sells, including product liability, labelling, authenticity and recall. A Driver additionally indemnifies us in respect of the operation of a vehicle and the performance of deliveries.
16. Governing law and disputes
16.1 These terms and any dispute arising out of them or out of the use of the Platform are governed by the laws of the State of North Carolina, without regard to its conflict of law rules.
16.2 Informal resolution first. Before starting a formal claim, please write to admin@chairsidedelivery.com with a description of the dispute and the outcome you seek. Both sides agree to try in good faith to resolve it within 30 days of that notice.
16.3 If the dispute is not resolved, it must be brought exclusively in the state or federal courts located in Wake County, North Carolina, and both sides consent to the personal jurisdiction of those courts. Either side may still bring an eligible claim in small claims court, and either side may seek injunctive relief to protect intellectual property or confidential information.
16.4 Each side brings claims only in its own capacity, and not as a plaintiff or class member in any class or representative proceeding.
16.5 If any part of these terms is held to be unenforceable, the rest stays in force. A delay in enforcing a right is not a waiver of it.
17. Changes to these terms
17.1 We may update these terms as the service changes or as the law requires. The current version and its effective date are always shown at the top of this page.
17.2 Where a change materially affects your rights, we will give notice by email or in the app at least 14 days before it takes effect, unless the change must be made sooner for legal or safety reasons.
17.3 If you continue to use the Platform after a change takes effect, you accept the updated terms. If you do not accept them, stop using the Platform and close your account.
